Terms, Conditions, Legal Notice & Privacy

TERMS AND CONDITIONS

PRICES All prices are net, FOB New York City, and do not include shipping and handling or taxes. Weitzner reserves the right to change prices without prior notice. Prices should be checked with the nearest showroom prior to ordering.

TERMS Full payment, including shipping and any other miscellaneous itemized charges, is required prior to shipment unless credit has been established. Thereafter, credit terms are net 30 days to approved accounts.

ORDERING A signed purchase order is essential. Telephone orders must be confirmed in writing. Catalogue number, fabric name and color must be included in the order. Please specify cut lengths required for window fabrics and wallcoverings. Please specify face or back for reversible fabrics. Fabric is sold in multiples of 1/4 yards with a 2 yard minimum per fabric. A $20 surcharge will apply to each fabric ordered in quantities less than the minimum.

Orders are subject to acceptance with issuance of written order acknowledgments which are final and binding. All order acknowledgments will include an anticipated delivery date. Orders may only be changed prior to shipment by written request. All such requests are subject to Weitzner’s ability to conform. Additional material, labor, administrative and/or other costs may be charged.

SHIPPING Complete shipping instructions as to carrier and routing should be included with the order. If no routing is specified (or if “best” routing is requested) Weitzner will select an appropriate carrier. All fabric is shipped at purchaser’s risk, FOB New York City, and Weitzner is not responsible for delays, failure of delivery, loss or damage in transit or storage.

As inventory levels can fluctuate due to allowances or shortages, Weitzner reserves the right to adjust cut lengths as necessary. Such circumstances may delay the release of goods for shipping.

We reserve the right to make partial shipments as goods become available. Invoices for such shipments are to be paid as they become due.

CANCELLATIONS Orders may not be canceled without the written consent of Weitzner. A cancellation charge of up to 25% of the total amount of the order may be applied. Orders requiring a deposit for which payment has been received are non-cancelable without forfeiture of entire deposit.

CLAIMS No claim may be made after goods have been cut or finished. Claims must be made in writing within 2 weeks from date of receipt of goods.

Weitzner will not be responsible for any costs other than those billed by Weitzner.

RETURNS No goods may be returned without Weitzner’s prior written consent. No return will be accepted for goods less than 10 yards or 3 panels. Unauthorized returns will not be accepted. A handling charge of up to 25% of the net merchandise amount may be charged on all approved returns, which must have a Weitzner Return Goods Authorization form attached.

QUALITY Goods are not guaranteed against fading, wearing, dimensional change or any other physical changes in appearance.

LIMITATIONS Variations in dyes, dye lots, yarns and spinning lots may cause variations between samples and shipped goods. A cutting of current stock will be sent upon request with order acknowledgment, except for products where CFA is not available. All weights and dimensions are approximate.

Cleaning and installation instructions, included with each shipment of wallcovering or available at www.weitznerlimited.com should be carefully read, understood and followed.

Weitzner offers third party finishing services, and will bill the client for shipping to the finisher and to the final destination. These orders are not returnable. Weitzner will not be responsible for any variations as a result of the specified elective finish.

RESERVES Reserves are good for two weeks and may be placed on goods in stock; no reserves against incoming stock will be accepted.

TESTING If testing information is required which is not contained herein, please contact Weitzner Customer Service.

CUSTOM ORDERS Custom orders will be accepted at Weitzner’s discretion. If sufficient time and minimum yardage requirements are met, Weitzner will develop custom colors and/or designs.

All custom orders require a written purchase order and a non-refundable 50% deposit to begin production. All custom orders are subject to a maximum of 10% overage on the production run; adjustments will be made on the final invoice.

Custom orders may not be canceled or returned. Custom patterns are sold by the piece only (piece sizes vary according to the design). Weitzner’s ability to produce a custom design or color once does not guarantee Weitzner’s ability to produce it in the future, which should be taken into account when calculating attic stock. DESIGNS All Weitzner designs are copyrighted by, and remain the sole property of, Weitzner.

Weitzner gathers navigational information during each visitor’s use of our Website. Weitzner will ask you to provide personal information when you sign-up online for our Newsletter. We also collect your personal information by allowing you to sign up for enter a contest, participate in a survey, check the status of a sample or in the future request a catalogue or sample.

Categories of information collected include name, gender, member affiliation, address, e-mail address, recipient’s name and e-mail address, order information, telephone number and credit card information.

Using Personal Information We Collect Online

Weitzner uses the personal information we collect from you for internal use, to fulfill requests that you have created, to contact you or the product recipient(s) in the event of sample delivery difficulties, for verification purposes, to respond to your inquiries, and to deliver services and information about our products or Website, including adding you to the Weitzner Newsletter list and to our mailing list when you sign up or when you purchase a sample. We will use the information you provide when you sign up for the Weitzner Newsletter to send you updates about Weitzner products, promotions and events. In addition, we will use your name, mailing address and e-mail address provided during such sign up in all the ways described in this privacy statement. The information gathered shall remain internal and will not be sold to any third parties.

Weitzner Newsletter and E-mail

The Weitzner Newsletter allows you to receive exclusive information about special offers, media events, new products, and much more. If you’re not already registered, simply complete our sign-up form to receive these special messages. If at any time you would like to stop future delivery of the Weitzner Newsletter or e-mails, please follow the removal instructions located at the bottom of each message or complete the “removal from e-mail” form. Asking to be removed from Weitzner’s E-mail list will not prevent you from receiving e-mail communications relating to any sample order you place at Weitzner, requests to participate in surveys about our products or other operational e-mail communications.

Gallery

You may submit photos or images of Weitzner’s products being used in a project to Weitzner. If a photo is accepted by Weitzner it will appear in the Gallery with the user’s name and their website, if provided, and the product reference. Once the photo or image is submitted, the submitter shall have authorized Weitzner to use the image or photo in any and all media or formats, including the Gallery of this website, without compensation.

Information We Share With Third Parties

Weitzner may occasionally provide you with the opportunity to opt-in to receive e-mail messages from third parties. If you do opt-in we will share your e-mail address with the specific third party from whom you have opted-in to receive e-mail messages.
